The new Equine Liability Law which took effect February 23, 2006 will affect the horse farm owners in Pennsylvania in a positive way. It will apply to any individual, group, club or business that sponsors, organizes, conducts or provides facilities for an equine activity. Some of these activities are boarding, grooming, trail riding, and most type of horse shows. One of the requirements to receive protection from this law is that two signs need to be posted at the farm. The signs need to say, “You assume the risk of equine activities pursuant to Pennsylvania Law”. The size is specific and can be acquired through the Pennsylvania Equine Council. The new law does not resolve all liability issues as the law does not apply to minors. There are many minors involved in Equine activities and this is still a large exposure for the farm owner. The farm owner should still use a release before allowing anyone to participate in these activities.

The new law does not eliminate the need for proper liability insurance. Negligent acts by farm and horse owners which cause bodily injury or property damage are best protected by the proper insurance plan. We will be able to review your needs and provide the coverage that will fit your budget.

Construction is completed at L&B Farms Of Hershey, Pennsylvania! Our new barn includes 18 stalls, an indoor riding arena, and a wash stall with hot water. We have an upstairs viewing area/lounge where we encourage parents to stay and watch their child during their lessons. We currently have three paddocks/pastures but are undergoing expansion.

Carriage and Wagon Ride Liability Insurance

There are many people in Pennsylvania who drive their horses on the public roads. Like many automobile owners, there are many who operate their wagons or carriages without liability insurance. Did you know that even if you did not cause an accident, you could have to defend yourself in a court of law if you are involved in an accident? Costly legal advice could be one of the expenses that you would have to pay without insurance. If the suit is successful and the judgment requires you to pay damages, you would also have these expenses to pay out of pocket. Some wagon and carriage owners like to give rides at local functions, such as churches, picnics, and weddings. They don’t consider it a business because they may not charge a fee and may accept a donation or may not operate on the public roads, however; these folks have the same liability risk that a professional carriage provider would have. When offering rides to anyone other than your immediate family you are at risk of being responsible for bodily injury or property damage to those on or around the carriage or wagon. There are many people who like driving their horses so much that they consider starting a business of livery including driving carriages at weddings and giving hay rides during pumpkin season. These commercial operations are involved with many people that can seek damage if injured by the operator of the carriage or wagon. We don’t like to think of the worst scenario, so we will just close in saying that proper liability insurance will solve most of the problems that are associated with driving wagons or carriages.
